These Terms govern your use of DRAM (the "Service"). By creating an account or otherwise using the Service you agree to these Terms. If you don't agree, please don't use the Service.
// 1 · ELIGIBILITY · AGE
You must be at least 18 years old (or the legal drinking age in your country, whichever is higher) to create an account. By registering you confirm that this is true.
DRAM is an information and personal-tracking platform. We do not sell, supply, or facilitate the supply of alcohol.
// 2 · YOUR ACCOUNT
- You are responsible for the accuracy of the information you supply.
- You are responsible for keeping your password confidential.
- Don't share your account or let anyone else use it under your identity.
- Notify us promptly if you suspect unauthorized access.
// 3 · ACCEPTABLE USE
You agree not to:
- Harass, threaten, or impersonate other users.
- Post unlawful, defamatory, or grossly offensive content (including in tasting notes, profile bios, and list titles).
- Submit deliberately false whisky metadata to the shared database.
- Use the Service to spam other users via lists, friend requests, or messages.
- Attempt to interfere with the operation of the Service, circumvent rate limits, or scrape data at scale.
- Use the Service for advertising or commercial promotion without our prior written consent.
We may remove content and suspend or terminate accounts that breach these rules. In serious cases we may report illegal content to the competent authorities.
// 4 · CONTENT YOU SUBMIT
You retain ownership of the content you submit (tasting notes, list titles, etc.). You grant us a worldwide, non-exclusive, royalty-free license to host, display, and present that content as needed to run the Service — including showing it to other users when your account's privacy setting is public.
Whisky metadata you add to the shared database (whisky name, distillery, region, tasting notes for the bottle, etc.) becomes part of the public database for the benefit of all users. You confirm you have the right to submit any text, image, or other content you upload.
// 5 · MODERATION
Other users can flag content for review. We may hide flagged content while reviewing it, and may remove or restore it based on the result. Repeated violations may result in account suspension or termination.
// 6 · NO MEDICAL OR PROFESSIONAL ADVICE
Content on DRAM is for general information and personal record-keeping. It is not medical, legal, or financial advice. Excessive alcohol consumption is harmful — please drink responsibly. If you have a problem with alcohol, contact a professional support service in your country.
// 7 · TERMINATION
You can delete your account at any time from Account → Delete account. We may suspend or terminate access if you breach these Terms or if required by law. On termination, the licenses you granted us survive only to the extent necessary to honor legal retention obligations and backups already in flight.
// 8 · DISCLAIMER · LIABILITY
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we exclude liability for indirect, incidental, consequential, or punitive damages. For any direct damages, our aggregate liability is limited to EUR 100 in the twelve months preceding the claim, or — for free-tier users — the fees paid (which, for free use, is zero).
Nothing in these Terms limits liability for damages caused by intent or gross negligence, for injury to life, body, or health, or any liability that cannot be limited under mandatory law (in particular the Produkthaftungsgesetz).
// 9 · GOVERNING LAW
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another EU member state, any mandatory consumer-protection provisions of that state remain unaffected.
Place of jurisdiction for disputes with merchants, legal persons under public law, or special public funds, arising out of these Terms is [CITY OF OPERATOR], Germany.
// 10 · CHANGES TO THESE TERMS
We may revise these Terms when the Service changes or the law requires it. We'll notify you of material changes in-app before they take effect. Continued use of the Service after a change means you accept the revised Terms.
// 11 · SEVERABILITY
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
